Personal injury claims: a two-tier system? | The Times

Larger and more straightforward claims may be favoured; those at the lower end or that are complex may be disadvantaged

The planned overhaul of the way personal injury cases are funded, due to take place this spring, will lead to a two-tier system for claimants and many could find it difficult to get professional legal representation.

Following implementation of the Jackson reforms and the Legal Aid, Sentencing and Punishment of Offenders Act, which will take effect from April 1 this year, the success fee payable to solicitors following a successful compensation claim will have to be paid by the claimant out of their compensation and will no longer be recoverable from the defendant.
